CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF May 18, 2004 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: RON KENNY, COMMUNITY SERVICES DIRECTOR <br />Item #1 <br />SUBJECT: RESOLUTION ESTABLISHING CERTAIN NEIN FEES AND <br />INCREASING CERTAIN EXISTING FEES FOR VARIOUS <br />COMMUNITY SERVICES DEPARTMENT PROGRAMS & SERVICES <br />DATE: May 10, 2004 <br />BACKGROUND: <br />The City has the authority to impose fees, charges and rates under the police power <br />granted by Article XI, Section 7 of the California Constitution and under the provisions <br />of Government Code section 66016. In addition to providing authority to impose fees, <br />State law also requires that fees imposed by the City may not exceed the estimated <br />reasonable cost of providing the service for which a fee is charged. Along with this <br />restriction on fee amounts, Section 66016 of the Government Code requires the City to <br />hold a public hearing prior to adopting fees and make available to the public the data <br />indicating the amount of estimated costs required to provide the service for which a fee <br />is being charged. <br />City staff has prepared the proposed resolution, which would set fees for specific services <br />in amounts calculated to offset the City's costs in providing the services. The resolution <br />would establish fees for certain services and increase the amounts of some existing fees. <br />DISCUSSION/ANALYSIS: <br />Staff has reviewed the costs incurred by the City in connection with providing various <br />Community Services Department programs and services. Based upon this review, Staff <br />has concluded that the current fees charged for these services are inadequate, or in <br />some cases nonexistent, failing to recoup more than a small fraction of the City's actual <br />costs. <br />Staff has analyzed the costs incurred by the City in providing these services and has <br />recommended fee amounts, which are estimated to match the City's costs. The <br />recommended fee amounts are those set forth in the proposed resolution. Many of the <br />fees reflect specific monetary amounts representing the estimated amount of staff time it <br />takes to provide a particular service, while others simply provide that the recipient of the <br />service will be charged for the amount of staff time spent in a particular situation. More <br />specific information about how the fees were calculated is set forth in Attachment I to this <br />report. <br />1 <br />
