CITY OF COLTON Item #2 <br />AGENDA REPORT <br />FOR THE COUNCIL MEETING OF MAY 189 2004 <br />TO: Honorable Mayor and City Council Members <br />FROM: Kenneth Rulon, Chief of Police <br />SUBJECT: An Ordinance of the City Council of the City of Colton, California, <br />Amending Chapter 10.40 of the Colton Municipal Code in its Entirety <br />Relating to Rotational Towing Services. <br />DATE: May 11, 2004 <br />BACKGROUND: <br />The contracts allowing the current towing providers to provide services for the City are set to <br />expire in August 2004. The police department has evaluated the existing contracts and desires to <br />make changes to improve the service and accountability of the towing operators through the <br />promulgation of rules and specifications. <br />DISCUSSION/ ANALYSIS: <br />The Police Department and the City Attorney have reviewed the current Ordinance relating to tow <br />services required by the police department. In that the current contracts are set to expire in <br />August of this year, the Police Department is requesting to amend the current Ordinance to <br />include the following elements: <br />1. Authorizes the Chief of Police to promulgate rules and specifications for towing services <br />provided to the City. Further, the ordinance provides the Chief of Police direction as to <br />what to include in the rules and specifications. <br />2. Authorizes the Chief of Police to prepare a towing rotation list. <br />3. Provides that the Chief of Police shall determine the number of towing operator permits <br />needed to provide service to the Police Department, and that the Chief of Police shall <br />select qualified towing providers in accordance with criteria promulgated in the rules and <br />specifications. <br />4. Requires towing operators to pay the City's administrative fees to cover the costs of the <br />City's towing program. The fees will be established by separate resolution of the City <br />Council. <br />5. Provides for minimum procedures for the revocation of towing operator and driver permits. <br />6. Authorizes the City to maintain its own towing yard, should the City Council ever decide <br />that such a yard is appropriate. <br />The Police Department will be preparing the rules and specifications for towing service and <br />vehicle storage yards prior to the implementation of the ordinance. <br />FINANCIAL IMPACT: <br />The proposed ordinance allows for the continued collection of Franchise Fees, and includes <br />provisions for the collection of administrative fees. As a result, the ordinance will provide revenue <br />to offset the costs of continuing to administer the City's towing program. <br />ENVIRONMENTAL IMPACT: <br />Not Applicable <br />
