CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF May 189 2004 <br />Item #16 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Amer Jakher, City Engineer ( ) <br />SUBJECT: Approval of 3 Resolutions for LLMD1 : 1) Resolution Initiating <br />Proceedings, 2) Preliminary Approval of the Engineer's Report, and <br />3) Resolution of the Intent. <br />DATE: <br />BACKGROUND: <br />May 3, 2004 <br />In compliance with the Landscape and Lighting Act of 1972, Part 2 of Division 15 of the Streets <br />and Highways Code of California, the City Council formed a Landscape and Lighting Maintenance <br />Assessment District. Currently, there are two Landscape Lighting and Maintenance Districts <br />(LLMD) within the City of Colton. Each District is provided the services of maintaining lighting, <br />landscaping and all applicable facilities within its boundaries. <br />Within the LLMD District 1, there are five zones. Each zone is levied a different amount that is <br />determined by the benefit units each property type (residential, industrial or commercial) is <br />assigned as compared to the 1.00 Equivalent Benefit Unit (EBU) a single family resident is <br />assigned; the single family unit is used as the basic unit of assessment. In addition to the EBU, <br />the other determining factor in establishing each zone's corresponding assessment is the acreage <br />of each parcel. The costs associated with maintaining the improvements within each zone are <br />then equally distributed to those parcels within the zone. Only parcels that directly benefit from <br />the improvements are assessed. <br />DISCUSSION/ANALYSIS: <br />Of the five zones, La Loma Hills (Zone 3) is not assessed a levy because currently the only <br />improvement within this zone is an entry monument on La Cadena Drive; the City funds this <br />improvement from the City's General Fund because it benefits not only Zone 3 but also the <br />general public. <br />The proposed Engineer's Report for FY 2004/2005 is available at the City Clerk's Office, it reflects <br />no changes in the assessments rates for Zone 2, Zone 3, Zone 4 or Zone 5. Zone 8 is shown to <br />experience a decreased assessment rate, however in this preliminary stage this report does not <br />include the costs incurred by all city staff in providing this service. <br />The Preliminary Report has been prepared by Muni Financial for the various LLMD Zones where it <br />is shown that there will be a shortfall for the maintenance of the improvements within Zone 4 and <br />Zone 5 because their costs are higher than their levied contribution. The reserve fund is no longer <br />able to cover this shortfall as it has in the past. <br />7/10/03 City Clerk's Office Cb <br />
