R-119-04 <br />2 <br />3 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, <br />4 PURSUANT TO GOVERNMENT CODE SECTION 21025, MAKING <br />DETERMINATION OF DISABILITY STATUS FOR LOCAL SAFETY EMPLOYEE <br />5 JOHN E. HOFFMAN <br />6 <br />7 WHEREAS, THE City of Colton (hereinafter referred to as Agency) is a contracting <br />8 agency of the Public Employees' Retirement System; and <br />9 WHEREAS, The Public Employees' Retirement Law requires that a contracting <br />10 agency determine whether an employee of such agency is in employment in which he is <br />11 <br />classified as a local safety member; is disabled for purposes of Public Employees' <br />12 <br />13 Retirement Law; and, whether such disability is "industrial" within the meaning of such law: <br />14 and <br />15 WHEREAS, the City Council confirms that a Worker's Compensation Claim was filed <br />16 by John E. Hoffman alleging disability from his position as Police Officer; and, whether such <br />17 disability is "industrial" within the meaning of such law; and, <br />18 <br />WHEREAS, the City Council has reviewed the medical and other evidence relevant <br />19 <br />20 to such alleged disability. <br />21 NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />22 The City of Colton hereby finds and determines that John E. Hoffman was rendered <br />23 incapacitated within the meaning of the Public Employees' Retirement Law for performance <br />24 of his duties in the position of Police Officer, that the disability was the result of multiple <br />25 <br />injuries including injuries to his right leg and ribs, under the provisions of Government Code <br />26 <br />Section 21156; and <br />27 <br />28 BE IT FURTHER RESOLVED that the City Council finds and determines that John <br />E. Hoffman was incapacitated within the meaning of the Public <br />Reso John Hoffman 101904 <br />Page 1 of 2 <br />
