FIRST AMENDMENT TO COOPERATIVE AGREEMENT FOR THE DESIGN AND CONSTRUCTION OF STREET IMPROVEMENTS FOR THE CENTER STREET EXTENSION BETWEEN BARTLETT AVENUE AND ORANGE STREET THIS FIRST AMENDMENT TO COOPERATIVE AGREEMENT FOR THE DESIGN AND CONSTRUCTION OF STREET IMPROVEMENTS FOR THE CENTER STREET EXTENSION BETWEEN BARTLETT AVENUE AND ORANGE STREET ("First Amendment") is made and entered into on this day of 2005, by and between the City of Riverside, a municipal corporation, hereinafter referred to as "Riverside", and the City of Colton, hereinafter referred to as "Colton", with respect to the following facts: RECITALS WHEREAS, on June 1, 2000, Riverside and Colton entered into a Cooperative Agreement for the design and construction of street improvements for the extension of Center Street ("Agreement"); and WHEREAS, Riverside and Colton desire to construct street improvements for the, Center Street Extension from Orange Street to Placentia Lane, erroneously identified in the Agreement as the Center Street Extension between Bartlett Avenue and Orange Street ("Project"); and WHEREAS, Riverside and Colton desire to amend the Agreement to 1) correct the definition of PROJECT; 2) designate the City of Riverside as lead agency for the duration of this Project; 3) extend the contract term through December 31, 2007; and 4) revise the property acquisition, contract administration and notice provisions of the agreement. AGREEMENT NOW, THEREFORE, incorporating the recitals set out above, Riverside and Colton agree as follows: 1. The PROJECT as referenced throughout the Agreement shall be defined as the Center Street Extension from Orange Street to Placentia Lane. 2. Section 1 of the Agreement is amended in its entirety to read as follows: "RIVERSIDE shall be the lead agency for acquiring right-of-way dedicated by property owners adjacent to the project.
