(c) Any delinquent account receivable arising from an <br />unpaid utility charge shall be subject to a late charge <br />in the amount of five percent (5%) of the delinquent <br />amount currently due and payable to the City, which <br />shall be collected in the manner provided in Section <br />3.38.010 of this code. Notwithstanding the foregoing, <br />accounts for utility charges with a balance of twenty <br />dollars ($20.00) or less shall not be subject to the late <br />charge imposed by this subsection (c). <br />(d) Nothing contained herein shall limit, restrict or <br />otherwise affect the imposition of greater late <br />charges, interest, penalties or other charges for late <br />payments as provided for by other sections of this <br />code, or by the laws of the State of California. <br />SECTION 2: Section 3.38.030 of Chapter 3.38 of Title 3 of the Colton Municipal Code <br />(`Reduction for Early Payments on Accounts Receivable") is hereby deleted in its entirety. <br />SECTION 3: This Ordinance shall become effective thirty (30) days after its adoption in <br />accordance with the provisions of California law. <br />SECTION 4: The City Clerk shall certify to the passage of this Ordinance and cause the <br />same or a summarythereof to be published within fifteen (15) days after adoption in a newspaper of <br />general circulation, printed and published in Colton, California. <br />PASSED, APPROVED AND ADOPTED this _ day of , 2005. <br />Deirdre H.
