LaCadena Drive Colton, CA 92324 Colton, CA 92324 Re: SCI Conditions of Approval -Mortuary Gentlemen_ The purpose of this letter is to set forth a letter agreement relating to a condition of approval for the mortuary currently under construction on property owned by SCI California Funeral Services, Inc. (SCI). Construction of the mortuary (at Montecito Memorial Park) was approved by the City subject to a condition that SCI dedicate an 88' Right of Way for future realignment of Reche Canyon Road along the west side of the Project (herein the "Reche Canyon ROW"), or enter into an agmem_ east w__ 1b tbp -Ci1y to dedicate at a later date, prior to Certificate of Occupancy. Over the past year, SCI has been working with the City to arrive at a correct legal description for the Reche Canyon ROW and to process the documentation for dedication of the Reche Canyon ROW. As we discussed in our meeting today, SCI is also in the process of filing additional applications relating to use of the property east and west of the Reche Canyon ROW. In order to coordinate the ROW dedication with those projects, SCI needs an additional six months from the date of issuance of the Certificate of Occupancy for the mortuary to complete the dedication process. Accordingly, request is made that the last date for dedication of the Reche Canyon ROW be August 1, 2006, six months after February 1, 2006 which is the anticipated date of the certificate of occupancy for the mortuary. By execution and delivery of this letter agreement to City, SCI agrees to dedicate the Reche Canyon ROW to City on or before August 1, 2006. This letter is intended to satisfy the condition to issuance of the certificate of occupancy for the mortuary described in the fust paragraph of this letter. Request is made that this letter agreement be presented to and approved by the City Council at its December 20, 2005 meeting.
