CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF FEBRUARY 01, 2005 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Jeannette Olko, Electric Utility General Manager <br />SUBJECT: Request for Approval of Professional Services Agreement with <br />Robert Ferguson in an Amount Not -To -Exceed $42,000 <br />DATE: January 24, 2005 <br />Item #8 <br />Robert Ferguson has worked for the City of Colton Electric Utility as a consultant under Ralph <br />Hitchcock and Associates from 1998 to 2003. He assisted the utility with power resource <br />development, most notably all issues surrounding the design and construction of the Agua Mansa <br />Power Plant. His familiarity with the city's electric transmission and distribution system and <br />knowledge of Southern California Edison's (SCE) business practices has proved to be invaluable. <br />Planning for the utility's future needs, especially with regards to upcoming negotiations with <br />Southern California Edison, create a need for Mr. Ferguson's expertise. <br />DISCUSSION/ANALYSIS: <br />Three tasks have been defined that require Mr. Ferguson's expertise and need to be completed <br />this year. These tasks are: negotiate and amend the Wholesale Distribution Access Tariff (WDAT) <br />with SCE; review and make recommendations to SCE Franchise Agreement, set to expire in <br />2006; assist with implementation of black start capability for Ague Mansa Power Plant. Mr. <br />Ferguson's knowledge of the city's electric system and SCE operations make him uniquely <br />qualified to make useful recommendations to staff regarding the WDAT and Franchise <br />Agreement. Municipal Code 3.08.140 (E) states that informal bidding requirements for non-public <br />projects may be waived if "it is in the best interest of the City and its administrative operations". <br />With a limited term of 12 months, a monthly fee of $3,500, and a narrowly defined scope of work, <br />staff believes that this agreement with Mr. Ferguson is in the best interest of the utility and the <br />City. <br />FINANCIAL IMPACT: <br />Funds are available in FY 0405 in the Electric Utility Administration Professional Services account <br />number 520-8000-8001-2350-0923-000. <br />ENVIRONMENTAL IMPACT: <br />None. <br />CONFLICT OF INTEREST — Gift Disclosure Requirements <br />Robert Ferguson, Owner and Representative <br />
