2 <br />U <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />(General Commercial) zoning district provides for land uses compatible with surrounding <br />property and the Colton Municipal Code. <br />SECTION 3. Based on the entire record before the City Council and all written <br />and oral evidence presented, the City Council finds the Zone Change is consistent with the City <br />of Colton General Plan ("General Plan"), and will systematically implement the goals and <br />objectives of the General Plan. Moreover, the City Council hereby makes the following specific <br />findings in accordance with Section 18.58.04 of the Colton Municipal Code and state law: <br />A. The proposed zone change is in conformity with the General Plan of the <br />City because a general plan amendment has been approved concurrently with the zone change <br />request. The general plan amendment changes the land use designation of the Subject Property <br />from "Limited Commercial" to "General Commercial." The proposed C-2 zoning designation is <br />consistent and in conformity with the proposed amended general plan designation. <br />B. There is a need in the community for more of the types of uses permitted <br />by the proposed zoning designation. The proposed C-2 zoning designation permits a broader <br />range of commercial uses that assist the City in meeting its economic development and service <br />needs. <br />C. The proposed change of zone will not adversely affect the surrounding <br />area or the community in general. The C-2 zoning designation's development standards provide <br />adequate separation and height requirements to assure that proposed uses do not significantly <br />adversely affect surrounding areas. Further, other development standards in Chapter 18.22 of <br />the Colton Zoning Ordinance assure that development undertaken pursuant to this zoning <br />designation is compatible with and will not adversely affect surrounding uses. <br />D. The City Council has determined the proposed zone change is in the <br />public interest because it provides additional commercial development opportunities in the City of <br />Colton. <br />SECTION 4. Based on the entire record before the City Council and all written <br />and oral evidence presented, the City Council finds the Zone Change complies with CEQA and <br />hereby adopts the negative declaration for the following reasons: <br />A. The negative declaration and initial study were prepared for the <br />Application contain a complete and accurate reporting of the environmental impacts associated <br />with the Application. The documents have been completed in compliance with CEQA and the <br />State CEQA Guidelines. <br />B. The negative declaration and initial study prepared for the Application <br />reflect the independent judgment of the City Council. <br />C. As the decision making body for the Application, the City Council reviewed <br />and considered the information contained in the negative declaration, initial study and <br />administrative record prior to approving the Application. <br />D. All environmental impacts of the Application are insignificant. There is no <br />substantial evidence in the record supporting a fair argument that the Application will result in <br />significant impacts. <br />RVPUB\MXM\682852.1 -2- <br />
