Resources Code §§ 21000 Et Seq.) DATE: July 7, 2005 BACKGROUND Annually, the City and the Redevelopment Agency for the City of Colton (Agency) receive updates to the California Environmental Quality Act (CEQA) Guidelines. These updates are provided by the offices of Best, Best and Krieger (BB&K), attorneys for the City and Agency. It has been standard practice for the City and Agency to adopt the updates by City Council and Agency Board Resolution to remain in compliance with State Environmental Law. DISCUSSION/ANALYSIS The City Council and Agency Board are requested to adopt the attached Resolutions amending and adopting Local Guidelines for implementing CEQA, and repeal earlier Resolutions addressing the same. The proposed amendments are consistent and compatible with the policies of the State of California, the City of Colton, and the Agency. The attached memorandum from BB&K, dated April 30, 2005, details the revisions to CEQA that are relevant to the City and Agency. FINANCIAL IMPACT There is no financial impact to the General Fund. The requested action is a text change only. A financial impact, unknown at this time, could occur should either the City or Agency not adopt the Resolutions amending CEQA Guidelines, and be challenged in a court of law for CEQA non-compliance. ENVIRONMENTAL IMPACT There are no environmental impacts related to adopting either of these resolutions. CONFLICT OF INTEREST N/A CONSISTENCY WITH IMPLEMENTATION PLAN Adoption of Resolution 844 enables the Agency to complete its goals and objectives in compliance with the California Environmental Quality Act.
