ITEM #9 <br />CITY OF COLTON <br />For the City Council and Redevelopment Agency Board Meeting of <br />J u ly 19, 2005 <br />TO: Ho ora le Mayor uncilmembers <br />H nora le A n C' n and Boardmembers <br />FROM: D' o u y evelopment Dir tor <br />Candace Cassel Redev pment Director'" <br />SUBJECT: Consideration and Approval of City Res ion and Agency <br />Resolution No. 844 Amending and Adopting Locai Guidelines <br />for Implementing the California Environmental Quality Act (Pub. <br />Resources Code §§ 21000 Et Seq.) <br />DATE: July 7, 2005 <br />BACKGROUND <br />Annually, the City and the Redevelopment Agency for the City of Colton (Agency) receive <br />updates to the California Environmental Quality Act (CEQA) Guidelines. These updates are <br />provided by the offices of Best, Best and Krieger (BB&K), attorneys for the City and Agency. <br />It has been standard practice for the City and Agency to adopt the updates by City Council <br />and Agency Board Resolution to remain in compliance with State Environmental Law. <br />DISCUSSION/ANALYSIS <br />The City Council and Agency Board are requested to adopt the attached Resolutions <br />amending and adopting Local Guidelines for implementing CEQA, and repeal earlier <br />Resolutions addressing the same. <br />The proposed amendments are consistent and compatible with the policies of the State of <br />California, the City of Colton, and the Agency. The attached memorandum from BB&K, dated <br />April 30, 2005, details the revisions to CEQA that are relevant to the City and Agency. <br />FINANCIAL IMPACT <br />There is no financial impact to the General Fund. The requested action is a text change only. <br />A financial impact, unknown at this time, could occur should either the City or Agency not <br />adopt the Resolutions amending CEQA Guidelines, and be challenged in a court of law for <br />CEQA non-compliance. <br />ENVIRONMENTAL IMPACT <br />There are no environmental impacts related to adopting either of these resolutions. <br />CONFLICT OF INTEREST <br />N/A <br />CONSISTENCY WITH IMPLEMENTATION PLAN <br />Adoption of Resolution 844 enables the Agency to complete its goals and objectives in <br />compliance with the California Environmental Quality Act. <br />
