I the City for the described services; and <br />2 WHEREAS, based on the information contained in this Resolution and all other information <br />3 presented to the City Council on this matter, the City Council desires to establish a redemption fee <br />4 for the retrieval and storage of abandoned shopping carts and laundry carts, underthe police power <br />5 granted to cities by Article XI, Section 7 of the California Constitution and pursuant to the provisions <br />6 of Government Code section 66016. <br />7 BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />8 <br />1. Notice of the public hearing at which this Resolution was considered was <br />9 properly given pursuant to the provisions of Government Code section 66016, in which: (1) the City <br />10 published notice of the public hearing twice at least 10 days before the date of the hearing; (2) the <br />11 City sent notice of the meeting at least 14 days in advance to any interested person who had filed a <br />written request; and (3) the City made available to the public at least 10 days before the meeting the <br />12 data indicating the amount of the estimated costs required to provide the service for which the <br />13 proposed redemption fee will be levied and the revenue sources anticipated to provide the service, <br />14 including General Fund revenues. <br />15 2. All oral and written presentations made to and heard by the City Council <br />16 during the public hearing for this Resolution were properly considered. <br />17 <br />3. The cost estimates, including the data upon which the cost estimates are <br />18 based, which was produced by City staff and considered by the City Council in establishing the <br />19 redemption fee pursuant to this Resolution, are reasonable cost estimates for the provision of the <br />20 City services to which the redemption fee pertains and were made available to the public pursuant to <br />Government Code section 66016. <br />21 <br />22 4. There is a reasonable relationship between the redemption fee to be collected <br />23 for the provision of City services described in this Resolution and the City's costs in providing those <br />24 services, as identified in the data made available to the public. <br />25 5. The redemption fee for the removal and storage of any abandoned cartwithin <br />26 the City shall be $25 per cart. <br />27 6. The redemption fee amount does not exceed the actual or estimated <br />28 reasonable costs to the City of providing the services to which the fee relates. Those services <br />include, but are not limited to, the following: (1) Street Division personnel staff time to retrieve <br />2 <br />
