(3) Clarify existing language to streamline the process for abatement of "unidentified carts."
These are carts that do not comply with the existing ordinance requirement to attach signs to carts
which identify the carts' owners. The clarification will allow unidentified carts to be picked up
immediately and notice provided to the owners within 24 hours. If the owners cannot be located,
the City Engineer will keep a record of each unidentified cart and all attempts to locate the owner.
(4) Correct a few minor typographical errors in the existing ordinance.
(5) Add a new section to the ordinance that authorizes the City to collect a fine of $50 from
cart owners for each "occurrence" (all carts picked up during a one -day period). This fine is
established in Business and Professions Code section 22435.7.
FINANCIAL IMPACT:
There is a potential beneficial financial impact from the proposed amendment, since collection of
the proposed $50 fine would incrementally increase City revenue.
ENVIRONMENTAL IMPACT:
Not applicable.
CONFLICT OF INTEREST — Gift Disclosure Requirements
Not applicable
City staff recommends that the City Council approve and adopt the proposed ordinance to amend
Chapter 6.18 of the Colton Municipal Code regarding the regulation of shopping carts and laundry
carts.
Attachment: Proposed ordinance
Prepared by: Aftab Hussain, Engineering Department
City Attorney
REVIEW TEAM
City Attorney: Finance Director:
City Manager: ai, OTHER:
