The Fire Department has also prepared a regular <br />ordinance to take effect in the standard time frame (i.e., 30 days after adoption at second <br />reading). <br />The proposed ordinances will make the following amendments to the Colton Municipal Code: <br />(1) Prohibit the sale, use, discharge and possession of any fireworks which are not "safe and <br />sane" fireworks. <br />(2) Make property owners and persons who control property liable for any sale, use, <br />discharge or possession of illegal fireworks on their property. <br />(3) Make all criminal and administrative penalties for violations of Chapter 6.32 ("safe and <br />sane" fireworks regulations) also apply to violations of Chapter 15.16 (Uniform Fire Code <br />regulations). <br />(4) Expand the definition of "fireworks" as provided in the Uniform Fire Code to include a wider <br />range of fireworks. <br />(5) Change the violation of Chapter 15.16 (currently an infraction) to a misdemeanor to be <br />consistent with the misdemeanor violation in Chapter 6.32. <br />FINANCIAL IMPACT: <br />Not applicable. <br />ENVIRONMENTAL IMPACT: <br />Adoption of the proposed ordinances would have a beneficial environmental impact by reducing <br />the risk of fire hazard due to the discharge of illegal fireworks. <br />CONFLICT OF INTEREST — Gift Disclosure Requirements <br />Not applicable. <br />RECOMMENDATION: <br />City staff recommends that the City Council adopt the proposed urgency ordinance and regular <br />ordinance amending Chapters 6.32 and 15.16 of the Colton Municipal Code. <br />Attachment: Proposed Urgency Ordinance and proposed regular Ordinance <br />Prepared by: City Attorney and Fire Department <br />REVIEW TEAM ONLY pp,� <br />city Attorney:M.
