CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF SEPTEMBER 6, 2005 <br />TO: HONORABLE MAYOR AND CITY COUNCIL ' <br />FROM: Anthony Arroyo, Human Resources Director 0� <br />ITEM #9 <br />SUBJECT: Approve Resolution Delegating Disability Retirement or Industrial <br />Disability Retirement Designation for Local Safety Officers to the <br />City Manager <br />DATE: August 22, 2005 <br />BACKGROUND: <br />Under the Public Employees' Retirement Law (PERL), the governing body of a California Public <br />Employees' Retirement System (PERS) contracting agency is required to make a determination as <br />to whether a local safety member is "disabled" for purposes of the PERL and to determine whether <br />such disability is "industrial" within the meaning of PERL. Government Code § 21173 permits the <br />governing body of a PERS contracting agency to delegate this authority, upon advice of the City <br />Council, to the incumbent in the position of its choice. <br />DISCUSSION/ANALYSIS: <br />It is recommended that, for the purpose of operational efficiency and to facilitate the judicious <br />designation of local safety members as "disabled" and the classification of such disabilities as <br />"industrial" or "non -industrial," the City Council delegate the authority for disability determinations to <br />the City Manager.
