Implementation of the DBE Program ensures nondiscrimination in the award and administration of <br />Federally funded contracts; it also serves to level the playing field for DBE's when competing for <br />local contracts. <br />The 2005-2006 Annual Overall DBE Goal for minority participation in each type of trade has been <br />established for the City of Colton at 12.9%; this DBE Goal has been further broken down into <br />11.6% race -conscious minority participation and 1.3% race -neutral minority participation. <br />A presentation to CalTrans of the Annual Overall DBE Goal for FFY 2005-2006 is attached <br />(Exhibit "B"). A Resolution (Exhibit "A") relating to the adoption of the 2005-2006 DBE Program <br />is also attached, as is a copy of the Notice of Disadvantaged Business Enterprise Program Goals <br />and Right to Public Comment (Exhibit "C") required by federal law. <br />CONFLICT OF INTEREST <br />None. <br />ENVIRONMENTAL IMPACT <br />There is no environmental impact presented by the adoption or the implementation of the DBE <br />Program Goals for FFY 2005-2006. Any Federally -funded or assisted project to be constructed <br />within the City of Colton is investigated for Environmental Impact and proposed mitigation <br />measures, if necessary, would be tied to the construction of the Project. <br />FINANCIAL/FISCAL IMPACT <br />The City of Colton must approve and adopt the DBE Program each year per federal guidelines; <br />failure to do so will directly impact the use of federal aid funds for any of the current year's CIP <br />Projects. <br />A notice relating to the DBE Program shall be published by the City of Colton in both minority and <br />majority local media. The City will accept comments from the public regarding the DBE Program <br />for a period of forty-five (45) days beyond the date of publication, after which the Council needs to <br />adopt the attached resolution. <br />Advertisement costs shall be paid from Account No. 100-6150-6151-2270; approximate <br />advertisement costs are expected to be less than $500.00. <br />RECOMMENDATION: <br />Staff respectfully recommends that: <br />- Council adopt the FFY 2005-2006 Annual Overall DBE Program Goal Information set <br />forth in the presentation to CALTRANS, as required by 49CFR26. <br />
