2 6Councilwoman Garcia stated this property and operation have been an eyesore for
<br />some time now, the applicant has not complied with the conditions, he has done
<br />nothing about the paving, and she would therefore like to make a motion to approve
<br />Staff's recommendation to revoke the permit. Motion seconded by Mayor Gonzales.
<br />Mr. Roy Nierman, Attorney for the applicant, reported that Mr. Farooque leases this
<br />property from Texaco, the owners. Mr. Nierman continued that Texaco plans to con-
<br />struct a new service station and office buildings in the near future, which would
<br />necessitate tearing up a good portion of the pavement. Mr. Nierman advised that al-
<br />though Mr. Farooque has obtained cost estimates for the paving of the property, in
<br />the amount of $8,000, it would seem rather premature to require him to pave the
<br />property at this time, in lieu of the proposed construction by Texaco.
<br />Mr. Farooque, applicant, stated he would be managing the new service station that
<br />Texaco will be constructing and he does not feel it is proper to ask him to spend
<br />money, that he does not have, to pave the property at this time.
<br />Mr. Nierman stated that he has a petition, containing approximately 293 signatures,
<br />supporting Mr. Farooque, and in favor of being able to continue this business.
<br />After additional discussion, a Roll Call Vote was taken on the motion that had been
<br />made, as follows:
<br />AYES: One; Garcia.
<br />NOES: Two; Rehrer, Gonzales.
<br />ABSENT: Two; Cisneros, Hayes.
<br />Motion did not carry.
<br />Moved by Mayor Gonzales, seconded by Councilman Rehrer, to approve the Planning
<br />Commission's recommendation allowing applicant, Jamshed Farooque, to continue
<br />to exercise permit, Index No. C-10-80. Upon Roll Call, the Vote was:
<br />AYES: Two; Rehrer, Gonzales.
<br />NOES: One; Garcia.
<br />ABSENT: Two; Cisneros, Hayes.
<br />Motion carried.
<br />COMMUNITY SERVICES DIRECTOR'S REPORTS AND RECOMMENDATIONS:
<br />Assessment District No. 78-2
<br />Director of Community Services Calvin Wang reported that Contract "B" of Assessment
<br />District No. 78-2, concerning installation of a three million gallon steel reservoir
<br />in La Loma Hills, is now complete. Mr. Wang advised there is a Change Order to
<br />the contract, an additional cost of $4,574, and a request for a time extension
<br />of 98 calendar days.
<br />Mr. Wang concluded Staff recommends approval of Change Order No. 2, in the amount
<br />of $4,574, accept the contract at 100% complete, and authorize the filing of the
<br />Notice of Completion for Assessment District No. 78-2.
<br />Councilwoman Garcia again expressed her opposition and dissatisfaction in these
<br />change orders, stating these items should be a part of the contract and should
<br />be provided for in the beginning, when the contract is approved, and not brought
<br />up at a later date causing additional expense to the City.
<br />Mr. Wang and Mr. Earl Young, representing Showalter & Associates, explained the
<br />problems encountered with the filling of the reservoir and the high concentra-
<br />tion of chlorine, which may have contaminated the domestic water supply.
<br />After additional discussion, moved by Mayor Gonzales, seconded by Councilman Rehrer,
<br />to approve Staff's recommendation as outlined concerning Assessment District No.
<br />78-2. Motion carried, with Councilwoman Garcia voting NO.
<br />Construction & Engineering Planning Files
<br />Fogg Street Grade Separation Project
<br />Mr. Wang gave a status report on the Fogg Street Grade Separation Project, referring
<br />to a map, and indicated this project would be heard by the Public Utilities Commis-
<br />sion in Los Angeles on Tuesday, March 31, 1981.
<br />Mr. Wang advised the consultants, Moffit & Nichols, are studying various alterna-
<br />tives of the crossing and the temporary railroad relocation plans, and both Staff
<br />and the consultants will make a formal presentation at the next regular Council
<br />meeting on this matter.
