from previous Council Meetings at the request of the applicant, Mr. Harry L. 15 1 <br />Keiffer, all three decisions, or recommendations, of the Planning Commission. <br />Mr. Aguilera continued that during a previous Planning Commission meeting, Mr. <br />Keiffer appealed the Staff requirement of an Environmental Impact Report for <br />Tentative Tract No. 9674, however, the Planning Commission upheld Staff's deci- <br />sion to require an EIR for this project due to the number of possible impacts upon <br />the environment, and the decision to require an EIR thereby rendered his Tentative <br />Tract application incomplete and could not be heard or processed by the Commission <br />as per State law. <br />Mr. Aguilera conluded Staff recommends that Index No. A-6-81, zone amendment, be <br />sent back to the Planning Commission for further study in view of the fact that <br />the new General Plan has been adopted, that the Environmental Impact Report Appeal <br />be denied on the grounds that the City is required to follow State law under the <br />California Environmental Quality Act, and that Tentative Tract No. 9674 be denied <br />since it is an incomplete application until the required EIR is submitted. <br />Mayor Gonzales asked if anyone desired to speak on this matter. <br />Moved by Councilwoman Cisneros, seconded by Councilman Hayes, to terminate the Public <br />Hearing. Unanimous vote. <br />Mayor Gonzales asked what was Council's desire on Resolution No. 4169. <br />Councilwoman Cisneros referred to a Mailgram from Mr. Harry L. Keiffer requesting <br />CEJ a continuance on this matter, stating she felt the continuance should be granted. <br />Q Councilwoman Garcia said a continuance on this matter has been granted several times <br />Q now, and she felt the matter should be settled. <br />Councilman Rehrer said he would go along with the request for a continuance this <br />time, but it would have to be the last. <br />After additional discussion, Mayor Gonzales asked for a Roll Call Vote on the request <br />from Mr. Harry L. Keiffer for a continuance of the Public Hearing on Planning Commis- <br />sion Resolution No. 1010 to Tuesday, March 2, 1982, which was as follows: <br />AYES: Three; Cisneros, Hayes, Rehrer. <br />NOES: Two; Garcia, Gonzales. <br />ABSENT: None. <br />The continuance was granted. <br />Zonin <br />P. No. 1013 <br />Mayor Gonzales declared the Public Hearing open. <br />City Clerk Ramos submitted the Affidavit of Publication and reported that a letter <br />of protest had been received from James S. and Zona Appleby. <br />Planning Director Aguilera reported that this zone amendment concerns the prezoning <br />of property commonly known as the Agua Mansa Cemetery area from M-1, light manufac- <br />turing, City of Rialto, to P.F., public facility, City of Colton, which is required <br />as the final steps of the annexation procedure with the Local Agency Formation Com- <br />mission. Mr. Aguilera advised the Cities of Colton and Rialto have negotiated for <br />an exchange of territory that will result in returning a historical landmark, the <br />Agua Mansa Cemetery, to the City of Colton and, in return, provide for a more logical <br />delivery of City of Rialto municipal services. <br />Mr. Aguilera continued the proposed change of zone to Public Facility would render <br />-- these properties in conformance to the Colton General Plan requirement for public, <br />quasi -public designation and, once given this zone change, the properties should be <br />compatible with the surrounding uses. Mr. Aguilera advised an Environmental Review <br />has been conducted and a Negative Declaration has been issued by the Local Agency <br />Formation Commission. <br />Mr. Aguilera stated the Planning Commission, at a public hearing held January 12, <br />1982, reviewed and studied this matter and recommended approval of the prezoning <br />as outlined in Planning Commission Resolution No. 1013. Mr. Aguilera concluded <br />Staff would recommend First Reading of Ordinance No. 1615. <br />Mayor Gonzales asked if anyone present desired to speak in favor of or in opposition <br />to this matter. <br />Mr. James S.
