to be provided by the District, as well as cost estimates for providing <br />these facilities and services. Also included is a description of the <br />area within the District and the rate and apportionment of the special <br />tax. <br />Mr. Zamora advised this public hearing will allow any interested person <br />to speak verbally, or in writing, in favor of or in opposition to the <br />proposed District. If the majority of property/land owners within the <br />District file a protest, the proceedings are automatically halted. If <br />not, Council may proceed with formation of the District. <br />Mr. Zamora stated if Council proceeds, a Special Election will be held <br />November 6, 1990, with respect to the levy of special taxes, bonded in- <br />debtedness in the amount of $10 million, and the process to be used to <br />establish an annual appropriations limit for the District. The City <br />Clerk will act as Elections Official and will conduct the Election at <br />City Hall. The City has received notification from the County Registrar <br />of Voters Office that as of October 22, 1990, there were no persons <br />registered to vote within the boundaries of Community Facilities Dis- <br />trict No. 90-1. Accordingly, since the number of registered voters is <br />less than 12, the voters in the Election will be the property owners. <br />If votes representing 2/3 of the property within the District are posi- <br />tive, the City may proceed to sell bonds to construct and/or purchase <br />infrastructure for public use, and to levy an assessment on an annual <br />basis to fund debt service and other services in the area in question. <br />Mr. Zamora concluded Staff recommends the City Council accept and file <br />the Report for Community Facilities District No. 90-1, as prepared by <br />the City's special tax consultant, Rod Gunn Associates, and adopt Reso- <br />lution Nos. R-120-90, R-121-90 and R-122-90, implementing the formation <br />of Community Facilities District No. 90-1. <br />Mr. Zamora also referred to a report from GRC-Copenhaver, Inc., on the <br />Mt. Vernon Corridor Public Parking Need Analysis. <br />Mayor Gonzales asked if anyone present desired to speak on this matter. <br />City Clerk Ramos advised that no written protests had been received. <br />City Clerk Ramos reported there are no registered voters within Commun- <br />ity Facilities District No. 90-1. <br />City Clerk Ramos reported she has received waivers from both property <br />owners within the District regarding the Special Election to be held <br />November 6, 1990. <br />City Clerk Ramos stated she concurs with the holding of the Special <br />Election for Community Facilities District No. 90-1 on November 6, <br />1990. <br />Moved by Councilman Lofy, seconded by Councilman Rios, the Public Hear- <br />ing was terminated.
