Mr. R. A. Villalobos, 600 North Diamond Bar Road, Diamond Bar, represent- <br />ing I.B.E.W. Local 47, spoke on behalf of David Duncan and his hearing <br />with the Civil Service Board, requesting that this matter be reheard as <br />Mr. Duncan has a right to a closed hearing, under Government Code Section <br />54957. <br />CLOSED SESSION: <br />The City Council adjourned to Closed Session at 6:05 p. m., to discuss <br />Personnel Matters, pursuant to Government Code Section 54957, and Pend- <br />ing Litigation, pursuant to Government Code Section 54956.9(a), and re- <br />convened at 6:40 p. m., all Members present. <br />Personnel <br />City Attorney Edwards stated the City Council unanimously approved the <br />findings and recommendation of the Civil Service Board and denied the <br />Appeal of David Duncan. <br />Litigation <br />City Manager Sotelo read a report regarding Litigation between the City <br />of Colton and Ted Brobeck, et al, San Bernardino County Superior Court <br />Case 245 991, advising that the settlement for the Judgement in Condem- <br />nation for this party amounts to $428,500., which the City must pay. <br />Funds are available to make the mandatory settlement payment, and this <br />action will complete the condemnation proceedings. <br />Moved by Councilman Lofy, seconded by <br />of $428,500. regarding Litigation with <br />by Staff. Unanimous vote. <br />ADJOURNMENT: <br />Councilman Rios, approving payment <br />Ted Brobeck, et al, as outlined <br />Moved by Councilman Rios, seconded by Councilman Lofy and unanimously <br />passed, Mayor Gonzales adjourned the Meeting at 6:43 p. m. <br />HELEN A.
