Mitigation Plan as to Reach ; development of RIX or Tertiary Treatment Facility; construct facilities <br />to implement ammonia reduction and nitrogen removal; develop industrial pretreatment program <br />maintenance and participate in Storm 'mater NPDes Remit Compliance; by September 1992, initiate <br />Enforcement Plan and Ordinance; and, inspect all open channels by December 1992 with <br />inspection of industrial facilities and all storm drains larger than 36" by June 1993. <br />Mr. !'dark Adelson declared he had recently conducted inspection of the Colton sewer facility and <br />found it severely below maintenance standards, He stated that the City was required to provide <br />a higher level of treatment at the present facility in 1985 and a compliance schedule was <br />established for completion by 1989. As the City of San Bernardino was given the same <br />requirements, Colton and San Bernardino joined in their compliance project for cost saving, cost <br />effectiveness and cast efficiency. <br />Mr. Adelson recalled that the state agency had initially imposed requirements in its Cease and <br />Desist Order to achieve compliance based on engineering studies; subsequently, the State Regional <br />Pater Quality Control board revised the Cease and Desist Order to enable the Cities to continue <br />with their planning. Now, 7 112 years later, the requirements are being enforced and the <br />enforcement agency sees no facilities nor reduction of ammonia and nitrogen contents to purify the <br />water. <br />Mr. Adelson warned that the California 'dater Code empowers the Regulatory Board to impose a <br />penalty of $5,000.00 per day that the City remains in non-compliance of its mandate. He reminded <br />the Cities that the Board has exercised a great degree of tolerance in addressing this situation. The <br />Regulatory Beard has come under criticism for not vigorously pursuing the Cease and resist Order. <br />Even now, he stated that the Board will continue to allow adequate time for construction of the <br />necessary facilities and for development of the process to ensure compliance. He informed that <br />the City of San Bernardino has constructed a large scale nitrogen removal facility and it is <br />considering a construction plan; RIX facility or conventional treatment facility, The City of Calton <br />needs to male choices soon or face serious consequences. The question remains whether the <br />Cities of Colton and San Bernardino gain by operating a joint operation. <br />Mayor Gonzales recalled that the Cities were considering entering into an experimental project to <br />participate in a regional board. He stated that the City of Colton was not mare that technology <br />studies based on infiltration and extraction processes had been completed. Mr. Adelson declared <br />that as long as progress is made to meet the Beard's requirements, the Board will continue to <br />exercise discretion to allow additional time. A good faith effort through demonstration is expected, <br />Mayor Gonzales informed that the City of Colton has the necessary land. He expressed belief that <br />it is now the time for the City to be decisive and move forward alone in an effort to avoid $5,000 <br />per day penalties and in a good faith effort to achieve compliance of the standards. Mayor <br />Gonzales directed staff to contact the City of San Bernardino to determine their present course of <br />action. <br />Public Utilities Director Schroeder announced that a two-month pilot study has been conducted <br />2 <br />
