She said the courts have been reluctant to <br />uphold measures that result .in involuntary forfeiture of office <br />during an elected, term. Her opinion was that the proposed <br />ordinance does not mandate involuntary forfeiture of a term o <br />office. Rather, it conditions eligibility to run for any other <br />elected municipal office on a voluntary resignation from the <br />position of City Councilmember. This ordinance places all <br />.incumbent City Councilmembers in the same position as that of those <br />City Councilmembers whose terms expire concurrently with any <br />municipal election. R-128-9 and <br />R-129-93. <br />. <br />Noting elections are costly, C'euneil.mem er Cisneros suggested that <br />the ballot measure be consolidated with the November 1994 election. <br />City Clerk Ramos stated that the ballot measure would be a special <br />election for the City and that it could be consolidated with the <br />County of San Bernardino. Councilmember Beltran amended his motion <br />to include that the ballet measure would be consolidated with the <br />County for the November election. It was noted that it the ballot <br />measure was to be voted on in November and it passed, the extension <br />f the Mayorge term would become effective in 1996. <br />Councilmember Sandoval asked City Clerk Ramos what monetary <br />difference existed if the measure was placed in June as opposed to <br />November. City Clerk Ramer informed that it depended on people <br />partici a.tien. There would be f ewer voters showing up in June than. <br />in November.; therefore, because of low voter turn -out expected, <br />printed materials would be lees in June.
