use this is a model to replace the present Property Maintenance <br />ordinance. <br />She advised that the Planning Commission has the hearing authority <br />previously vested in the Housing Appeals Board regarding <br />enforcement of the Uniform Building Code so that expanding its <br />authority to encompass property maintenance enforcement would be <br />appropriate. .Alternatively, City Council could direct that a new <br />body be created having authority to handle all code enforcement <br />matters administratively. A major improvement is that the cost of <br />correction of defective property can be assessed against the <br />property and collected by the County as part of the next regular <br />tax bill.. The Lien could be foreclosed against the property if it <br />is not. paid. In this manner the City may ultimately expect <br />reimbursement for all of its costs, including the cast of notices <br />and inspections. <br />She assured that an administrative procedure for code enforcement <br />could still result in criminal prosecution where defendants refuse <br />to comply with the directives of the administrative body. For an <br />effective criminal prosecution, City Attorney Biggs suggested <br />citations be clearly written with specific court dates set for a <br />time when City can be properly represented. <br />Community Development .Director Zamora declared it would be cost <br />effective to resurrect the Housing Advisory and. Appeals Board with <br />Planning Commission designated to hear 'matters regarding land use <br />and the Housing Appeals Board designated to hear ratters regarding <br />structural items. <br />City Attorney Biggs stated she would be drafting a new Property <br />Maintenance Ordinance to include an administrative procedure.
