SPECIAL COUNCIL MEETING JUNE 19,1997 .A. Special Meeting of the City Council of the City of Colton was held at 4:56 p.m,, on the above - given date in the Council Chambers of City Hall, located at 650 North La Caden-a Drive, Colton., Califoniia, Mayor Gaytan presiding, Notice of Special. Meeting was given on. June 1.8, 1997, in ZP comphance with Government Code Section 54956. FD_kG SALUT - Mayor Gaytan led the assembly in the. pledge of allegiance. ROLL CALL- Councilmembers present were Sandoval, Bennett, Cook, Chastain, Hutton, Sanders, and Mayor Gaytan. Also present were Acting City Manager Harmon., City Attorney Biggs, and City Clerk - B arrera. )PEN HEARINU I City.Aftomey Biggs ainiounced that the City Council would meet in Open Session to confer with legal counsel regarding two personnel matters pursuant to the Government Code §54957 involving potential discipline. dismissal or release, City Attorney Biggs ftirther explained that the provisions of the Bmwli-,Nct required that whenever a Closed Session under this section is held, or is scheduled to be held, notice must be given to the individuals against whom complaints or charges may be heard or discussed. She stated -that. notice was given prior to the meeting of June 16, 1997, and at the time the notice was cuiven, to the individuals involved, City Manager Malik Freeman requested that his hearing be held in open session. For that reason, there was no discusslon of his matter at the June 16, 1997 Closed Session.. Since that time Mr. Daryl Parri,sh, the other individual involved. in this matter, also requested that his 'be held and discussed.M. Open Session,, -1 -e -thing related to matters therefin - it was determined that every him will also be discussed in open. session, Attornev Bigas introduced Attomey Donna Baker of Thomas, Mort, Prosser & Knutsen, who would I Z� present the materials for this disciplinary discussion.. The discussion would be amongst the Councilmembers and not open to public comment. Attorney Biggs said the Council had the discretion, if it chooses to, to ask witnesses to s- cak, She summarized that the matter was not a P public hearing and not suklect to the requirement for public comment. Attorney Baker stated that the first matter to be discussed was in regard to City Manager Malik Freeman. She indicated that is a report fromMark- McDonald regarding his investigation on the Tao rmina Contract andMr. Freeman's involvenaent in that contract would be. presented and that other issues with respect to the perfion.nance of the City Manager have been. raised and that she would present those issues.
