1 (e) The phrase "construct and use" shall mean to lag, 2 construct, erect, install, operate, maintain, use, repair 3 or replace. 4 Section 2. The franchise to construct and use for 5 transmitting and distributing electricity to the public for 61any and all purposes, poles, wires, conduits and appurtenances, 7�including communication circuits necessary or proper therefor 8 1 in, along, across, upon and under the public streets, ways, alleys, l 9 and places within the City of Colton, is hereby granted to Southern 10 ;California Edison Company, upon the terms and conditions set l 11 forth in the Franchise Act of 1937• 12 Section 3. Said franchise shall be indeterminate, that 13 is to say, said franchise shall endure in full force and effect 14 until the same shall, with the consent of the Public Utilities 15 Commission of the State of California., be voluntarily surrendered i' 16or abandoned; by the grantee, or until the State or some municipal 17 or public corporation thereunto duly authorized by law shall 18 purchase by voluntary agreement or shall condemn and take under 19 the power of eminent domain, all. property actually used and use - 20 f ul in the exercise of said franchise and situate in the terri- 21 torial limits of the State, municipal or public corporation 22 purchasing or condemning such property, or until said franchise 23 shall :)e forfeited for noncompliance with its terms by the 24 grantee. 25 Section_4. The grantee of said franchise shall, during 26 the term thereof, pay to said City, a sum annually which shall 27 be equivalent two per cent {2%) of the gross annual receipts 28 of said grantee arising from the use, operation or possession of 29 said franchise; provided, however, that such payment shall be in 30 no event be less than a sum which shall be equivalent to one 31 per cent {_ld'�) of the gross annual receipts derived by grantee 32 from the sale of electricity within the limits of such City 2
