Bid securities received by the <br />Purchasing Agent will be filed with the City Clerk. <br />j): Rejection of Bids. The City Manager shall present the tabula- <br />tion of bids received to the City Council, In its descretion, the City Council <br />jmay reject any or all bids and authorize the re -advertising for bids. <br />k), Award of Contract. Contracts shall be awarded by the City <br />Council to the lowest and best bidder except as provided herein, <br />1, Tie Bids. If two or more bids are for the same total amount or <br />unit price, quality and serviFe being equal, and if the public interest will not <br />permit the re --advertising or reposting for bids, the City Council may accept the <br />one it chooses or accept the lowest bid made by negotiation with the tie bidders <br />at the time of awarding the contract, <br />m)f Performance Bonds. The City Council may require a perfor- <br />mance bond of the successful bidder before entering a contract* The amount <br />of the bond shall be in an amount that the City Council finds reasonable to pro- <br />tect the best interests of the City. If the City Council requires a performance <br />bond, the form and amount shall be stated in the bid specifications. <br />n) Labor and Materials Bonds. The City Council may require a <br />labor and materials bond of the successful bidder before entering a contract„ <br />The amount of the bond shall be in an amount that the City Council finds reason- <br />able to protect the best interests of the City. If the City Council requires a <br />labor and materials bond, the form and amount shall be stated in the bid <br />specifications, <br />a; Forfeiture ofBid Security. A successful bidder shall forfeit <br />his bid security upon refusal or failure to execute a contract with the City of <br />Colton within ten days after the notice of award of contract has been mailed by <br />the City Clerk, unless the City is responsible for the delay, The City Council <br />may then award the contract to the second lowest bidder and apply the amount of <br />the forfeited bid security to the difference between the low bid and the second log <br />bid. <br />
