by means of electrical materials or devices. <br />2''.; Section 2 - PUBLIC HEARING BY COUNCIL <br />r' The Council may from time to time call public hearings <br />,I <br />s1 i <br />to ascertain whether the public necessity, health, safety or <br />,j welfare requires the removal of poles, overhead wires and asso- <br />ciated overhead structures within designated areas of the City <br />t s <br />� s <br />and the underground installation of wires and facilities for <br />i <br />9 supplying electric, communication, or similar or associated <br />101 service. The City Clerk shall notify all affected property <br />i I <br />1'1 ii owners as shown on the last equalized assessment roll and util- <br />1`' <br />�% ities concerned by mail of the time and place of such hearings <br />131 <br />at least ten (10) days prior to the date thereof. Each such <br />14 i <br />15 j hearing shall be open to the public and may be continued from time <br />I <br />16 , <br />to time. At each such hearing all persons interested shall be <br />to be heard. The decision of the council <br />17l1 given an opportunity y <br />18 shall be final and conclusive. } <br />lgl� Section 3 - COUNCIL MAY DESIGNATE UNDERGROUND UTILITY <br />� DISTRICTS BY RESOLUTION <br />20 <br />21 ;l If, after any such public hearing the Council finds that <br />2211 <br />the public necessity, health, safety or welfare requires such <br />2.3 <br />11 removal and such underground installation within a designated <br />I <br />2¢� area, the Council shall, by resolution, declare such designated <br />25 i <br />area an Underground Utility District and order such removal and <br />26 <br />underground installation. Such resolution shall include a de - <br />27 <br />28 j scription of the area comprising such district and shall fix: the <br />�Ii <br />29j!time within which such removal and underground installation shall_ <br />i <br />30' be accomplished and within which affected property owners must <br />31'11 d to receive underground service.
