2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11� <br />ORDINANCE NO. 1539 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF COLTON, STATE OF CALIFORNIA, ES- <br />TABLISHING A MOBILE HOME RENT REVIEW COM- <br />MISSION. <br />THE CITY 'COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: <br />SECTION I. There is presently within the City of Colton and the <br />surrounding areas, a shortage of spaces for the location of mobile homes. Be- <br />Icause there is a shortage, there is a low vacancy rate, and rents have been for <br />k <br />several years, and are presently, rising rapidly and causing concern amongst a <br />substantial number of Colton residents. Because of the hinh rnc+ of mr%%,4-.. <br />;mobile homes, the potential for damage, resulting therefrom, the requirements re - <br />12 dating to the installation of mobile homes, including permits, landscaping and <br />i <br />3.3 site preparation, the lack ofalternative homesites for mobile home residents. <br />14 -!and the substantial investment of mobile homeowners in such homes, the City <br />i <br />15 lCouncil finds and declares it necessary to protect the owners and occupants of <br />16 mobile homes from unreasonable rent increases while at the same time, recogniz- <br />1 ling the need of the park owners to receive a "fair return on their investment <br />18land rental increases sufficient to cover the increased cost of repairs, mainte- <br />19 mance, insurance, upkeep and additional amenities. <br />20 1 SECTION 2. Definitions. <br />21 (1) "Commission". The Mobile Home Rent Review. Commission estab <br />22 1 i shed by Section 4 of this Ordinance. <br />23 1 (2) "Members". Commissioners of the Mobile Home Rent.Review <br />24 (Commission. <br />25 (3) "Space Rent". The consideration, including any bonus, bene - <br />25 ifits or gratuity demanded or received in connection with the use and occupancy <br />27 of a mobile home space in a mobile home park, or for the transfer of a lease for <br />28 'park space, services and amenities,.subletting and security deposits, but ex <br />- <br />i <br />of any amounts paid for the use of the mobile home dwelling unit. <br />
