3 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />g4 <br />15 <br />1+C ; <br />i <br />1711 <br />18' <br />29 <br />1which is the subject of a petition for hearing and which is later determined by <br />the Commission to have been excessive, shall be either returned to the tenants <br />or credited to future rental charges. <br />(10) In evaluating the rent increase proposed or effected by the <br />mobile home park owner, operator or manager, the Commission shall consider in- <br />creased costs to the owner attributable to increases in utility rates andro - <br />p p <br />kerty taxes, insurance, advertising, governmental assessments cost -of -living <br />11increases attributable to incidental services; normal repair and d maintenance, <br />jcapital improvements, upgrading and addition of amenities or services.as well <br />as fair rate of return on investment and increased property values. <br />(11) The conclusions and findings of the Commission shall be <br />;final and there shall be no appeal rights to the City Council. <br />SECTION 7. Separability. If any section, subsection, sentence, <br />clause, or phrase or portion of this Ordinance is for any reason held invalid or <br />unconstitutional by any court of competent jurisdiction, such portion shall be <br />deemed a separate, distinct and an independent provision and such decision shall <br />not affect the validity of the remaining portions thereof. <br />SECTION 8. Unless extended by further City Council action, this <br />!Ordinance shall expire and have no force or effect on and after January 1, 1981. <br />26 <br />1 SECTION 9. <br />21 The Mayor shall sign this Ordinance and the City <br />� <br />Clerk shall attest thereto, and shall cause the same to be published once in the <br />22 <br />2� 'Colton Courier, a newspaper of general circulation in the City of Colton, and <br />ithirty (30) days thereafter, this Ordinance shall take effect and be in force <br />24 liaccording to law. <br />25 <br />26 PASSED, APPROVED and ADOPTED this day of <br />2711 1 <br />ATTEST: <br />28 <br />HELEN A.
