1 ORDINANCE NO. 1586 <br />2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF COLTON AMENDING SECTION 3O ORDINANCE NO. <br />3 1471 AND SECTION 5.02.500 OF'THE 'COLTON MUNI- <br />CIPAL CODE PROVIDING FOR A BUSINESS LICENSE <br />4 TAX FOR AUCTIONEERS. <br />5 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLTON AS <br />6 FOLLOWS; <br />7 That Section 3 of Ordinance No. 1471, and Section 5.02 500 of the <br />8 Colton Municipal Code, are hereby amended to read as follows: <br />9 SECTION 1. 5.02.500 Auctioneers. For every person, firm, or <br />10 corporation conducting, managing or carrying on or engaged in the business of <br />11 selling at auction any personal property whatsoever, the tax shall be Five Hun- <br />12 dred Dollars ($500) per calendar year or fraction thereof, payable in advance; <br />13 provided, however, the provisions of this section shall not apply to any person, <br />14 firm or corporation having an established permanent place of business for con <br />15 ducting a public auction and who, in addition thereto, provides space for private <br />1.6 endors, in which case the license shall be based upon `the annual <br />gross receipts <br />17 Df the public auction plus the fee of Two Dollars and Fifty Cents ($2.50) per <br />18 Jay for each space rented to a private vendor on a dailybasis. . (Report and pay- <br />19 flent to be made on a monthly basis). The provisions of this section shall not <br />20 apply to any person, firm or corporation having an established and permanent place <br />21 f business in the city and paying a license to the.city therefor, who may auction <br />22 ny goods, wares or merchandise for purposes of winding up the affairs of said <br />23- usiness-or for the purpose of closing out any special line of goods, wares or <br />24 nerchandise or other personal property that may then be in stock or in their <br />25 ossession at the commencement of the auction at.said place of business or place <br />26 qhere said property is regularly kept without making a regular practice of doing <br />27 o or without adding to the stock to be auctioned after the commencement of the <br />28 uction. <br />
