1 ORDINANCE NO. 0-26-03 <br />2 <br />3 AN ORDINANCE OF THE CITY OF COLTON AMENDING <br />CHAPTER 5.02 OF THE COLTON MUNICIPAL CODE <br />4 REGARDING BUSINESS LICENSE TAX <br />5 WHEREAS, The City Council of the City of Colton recognizes that the Colton <br />6 Municipal Code intends that the issuance of a business license must be for the sole purpose of <br />7 <br />raising revenue and not for the purpose of regulation; and <br />8 <br />WHEREAS, In 1975, the City Council adopted Ordinance No. 1471 which established <br />9 <br />procedures for issuing business licenses; and <br />10 <br />WHEREAS, since 1975, the increased number and types of businesses within the <br />11 <br />City have created the need to update and improve the City's procedures for issuing business <br />12 <br />licenses; and <br />13 <br />14 WHEREAS, the City Council established business license amounts in 1975 with the <br />15 adoption of Ordinance No. 1471 and later amended those amounts in 1992 with the adoption of <br />16 Resolution No. R-73-92; and <br />17 WHEREAS, it in the best interest of the City of Colton to maintain consistency <br />18 between the intent of the Colton Municipal Code and the City's ordinances and resolutions by <br />19 consolidating the language of Resolution No. R-73-92 with the Colton Municipal Code in order to <br />2o have one uniform document setting the amounts charged by the City for business licenses; and <br />21 WHEREAS, passage of this Ordinance will consolidate the resolution language with <br />22 the Colton Municipal Code without increasing or adjusting in any way the amounts charged for <br />23 business licenses as previously set by Resolution No. R-73-92; and <br />24 WHEREAS, the City Council also desires to amend other existing provisions of the <br />25 Colton Municipal Code in order to improve the City's process for issuing business licenses, <br />26 including: (1) revising the appeals process to allow the City Manager to be the hearing authority, <br />27 while ensuring an individual's right to appeal to the City Council; (2) ensuring that subcontractors <br />28 <br />RVP U B/NGS/661186 <br />1 <br />
