1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13'1 <br />14 <br />151! <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-01-04 <br />AN URGENCY ORDINANCE OF THE CITY OF COLTON <br />ESTABLISHING A UTILITY USER TAX <br />WHEREAS, the City of Colton is facing serious difficulties in meeting its <br />financial obligations; and <br />WHEREAS, it is imperative that the City of Colton generate sufficient <br />revenues to meet its obligations to provide service to the citizens of Colton and to <br />compensate city employees for work performed in connection with the provision of such <br />services; and <br />WHEREAS, the City of Colton finds and determines that an emergency <br />situation exists necessitating the immediate and urgent implementation of an immediately <br />effective ordinance under the provisions of Government Code Section 36934 imposing a <br />utility user tax to generate operating funds for the City of Colton in order to assure that <br />necessary public services are provided to the community and that city employees are <br />properly compensated for work performed; and <br />WHEREAS, the City Council has adopted Resolution No. R-126-03 which <br />has placed on the ballot for the City's March 2, 2004 special election the question as to <br />whether the City shall adopt this Ordinance establishing a utility users tax; and <br />WHEREAS, the Colton voters' approval of this Ordinance shall be deemed <br />to satisfy the legal requirements concerning voter approval of taxes as set forth in Article <br />3.7 of Chapter 4 of Part 1 of Division 2 of Title 5 of the California Government Code <br />(Proposition 62). <br />NOW, THEREFORE, THE <br />ORDAIN AS FOLLOWS: <br />RVPUB/NGS/660760 <br />PEOPLE OF THE CITY OF COLTON DO <br />1 <br />
