1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16, <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-07-04 <br />AN ORDINANCE OF THE CITY OF COLTON, CALIFORNIA, AMENDING PORTIONS OF <br />TITLE 14 AND SECTION 15.04.030 OF THE MUNICIPAL CODE OF THE CITY OF <br />COLTON RELATING TO STORM DRAIN AND GRADING REGULATIONS <br />WHEREAS, Section 402(p) of the Clean Water Act establishes a framework for <br />regulating municipal stormwater discharges through the issuance of National Pollutant <br />Discharge Elimination System ("NPDES") permits; and <br />WHEREAS, the City of Colton is a co -permittee on the NPDES permit issued by the <br />California Regional Water Quality Control Board, Santa Ana Region, in April of 2002 through <br />Order No. R8-2002-0012 ("Permit"); and <br />WHEREAS, the Permit requires the City to review and revise its ordinances to <br />maintain the legal authority necessary to enforce the Permit; and <br />WHEREAS, the City has reviewed its ordinances and has determined that <br />amendments to the grading and stormwater provisions of the Colton Municipal Code will <br />assist the City in maintaining the legal authority necessary to enforce the Permit. <br />NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />ORDAIN AS FOLLOWS: <br />SECTION 1. The following definitions contained in Section 14.01.030 of the <br />Municipal Code of the City of Colton are hereby amended to read as follows: <br />"Best management practice (BMP)" means any prohibitions, practices, <br />procedures, programs or other measures designed to prevent or reduce the <br />direct or indirect discharge of pollutants into waters of the United States. <br />BMPs shall include, but are not limited to, those measures specified in the <br />California Storm Water Best Management Practice Handbook for Municipal, <br />Industrial/Commercial and Construction Activity, and those identified by the <br />director. <br />"Director" means the city engineer, or his/her designee. <br />"Stormwater pollution prevention plan (SWPPP)" means the plan as <br />described in the most recent General Permit for Discharges of Stormwater <br />associated with Construction Activity as issued by the State Water Resources <br />Control Board, or any amendment, modification or replacement thereto. <br />SECTION 2.
