1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-07-05 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF COLTON APPROVING A CHANGE OF ZONE FROM R-2 <br />(MEDIUM RESIDENTIAL) TO M-1 (LIGHT INDUSTRIAL) FOR <br />PROPERTY LOCATED AT 309 WEST CONGRESS STREET <br />IN THE CITY OF COLTON: DAP NO. 000-373 <br />WHEREAS, Moss Equipment Rentals filed an application (File No. DAP -000- <br />373) requesting a zone change from R-2 (Medium Residential) to M-1 (Light Industrial) <br />("Application") for property located at 309 West Congress Street (Assessor Parcel No. 0163- <br />202-21) in the City of Colton, County of San Bernardino ("Subject Site"); and <br />WHEREAS, the Application was reviewed, studied, and found comply with the <br />California Environmental Quality Act ("CEQA") as more fully described below; <br />WHEREAS, on March 22, 2005, the Planning Commission of the City of <br />Colton ("Planning Commission") conducted a duly noticed public hearing on the Application <br />at which time all persons wishing to testify in connection with the Application were heard and <br />the Application was fully studied; <br />WHEREAS, the Planning Commission adopted a Resolution recommending <br />approval of this Zone Change to the City Council; <br />WHEREAS, on May 3, 2005, the City Council of the City of Colton ("City <br />Council") conducted a duly noticed public hearing on the Application at which time all <br />persons wishing to testify in connection with the Application were heard and the Application <br />was fully examined; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution <br />have occurred; <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS <br />FOLLOWS: <br />SECTION 1. Based on the entire record before the City Council, all written <br />and oral evidence presented to the City Council, and the findings set forth in this Ordinance, <br />the City Council of the City of Colton hereby designates the Subject Site shown on the <br />
