Section 6.18.110 of Chapter 6.18 of the Colton Municipal Code is <br />deleted in its entirety and restated to read as follows: <br />"Section 6.18.110 Notice of violation --Unidentified cart. <br />(a) Within ten days of the removal of an abandoned cart pursuant to this <br />chapter, the director shall provide notice to any known owner of the cart by first-class mail at the <br />address indicated on the cart or the owner's last known address. The notice shall include the <br />following information: (1) date and location of removal of the cart from public or private property; <br />(2) procedure for recovering such cart; and (3) last possible date such cart may be recovered. <br />(b) If the owner of the cart is unknown and not clearly identified on the cart, <br />the cart shall be designated "unidentified." Immediately following such designation, the director <br />shall file a record with the city clerk for each unidentified cart containing the information above <br />and a brief description of the cart." <br />SECTION 7. Section 6.18.120 of Chapter 6.18 of the Colton Municipal Code is <br />amended by deleting the words "Section 6.18.120" and replacing them with the words "Section <br />6.18.110." <br />SECTION 8. Chapter 6.18 of the Colton Municipal Code is amended by adding <br />new Section 6.18.140 to read as follows: <br />"Section 6.18.140 Fine for each occurrence. <br />Pursuant to California Business and Profession Code section 22435.7, <br />subdivision (f), the city may fine the owner of a shopping cart in an amount not to exceed fifty <br />dollars ($50) for each occurrence in excess of three (3) during a specified six-month period for <br />failure to retrieve shopping or laundry carts in accordance with this chapter. An occurrence <br />includes all shopping or laundry carts impounded in accordance with this chapter during a one - <br />day period." <br />SECTION 9. Effective Date. This Ordinance shall become effective thirty (30) <br />days after its adoption in accordance with the provisions of California law. <br />SECTION 10: The City Clerk shall certify to the passage of this Ordinance and <br />cause the same or a summary thereof to be published within fifteen (15) days after adoption in a <br />newspaper of general circulation, printed and published in Colton, California. <br />PASSED, APPROVED, AND ADOPTED, this 5t" day of July, 2005. <br />AA <br />DEIRDRE H.
