<br />Section 207-F is amended by changing the definition of `Fireworks 1.4 G (formerly
<br />Class C, Common Fireworks)' and `Fireworks 1.3G (formerly Class B Special, Fireworks)' to read
<br />as follows:
<br />Fireworks are any combustible or explosive composition, or any substance,
<br />combination of substances, or device prepared for the purpose of producing a visible or audible
<br />effect by combustion, explosion, deflagration, or detonation. Fireworks include blank cartridges,
<br />toy pistols, toy cannons, toy canes or toy guns in which explosives are used; firecrackers,
<br />torpedoes, sky -rockets, model rockets, Roman candles, sparklers, or other devices of like
<br />construction; any devices containing an explosive or flammable compound; and any tablet or
<br />other device containing an explosive substance. Fireworks do not include auto flares; paper
<br />caps containing an average of 0.25 grain of explosive content per cap or less; and toy pistols, toy
<br />canes, toy guns or other devices for use of such caps. See also Appendix VI -H."
<br />SECTION 4. Section 15.16.480 of Chapter 15,16 of the Colton Municipal Code
<br />is deleted in its entirety and restated to read as follows:
<br />"Section 15.16.480 Penalties.
<br />A. Any person who shall violate any of the provisions of this chapter or fails to
<br />comply with any order made thereunder, or who shall build in violation of any detailed statement
<br />of specifications or plans submitted and approved thereunder, and from which no appeal has
<br />been taken, or who shall fail to comply with such an order as affirmed or modified by the city of
<br />Colton or by a court of competent jurisdiction, within the time fixed herein, shall severally for
<br />each and every violation and noncompliance respectively, be guilty of a misdemeanor,
<br />punishable by a fine or by imprisonment for not more than six months or by both such fine and
<br />imprisonment. The imposition of one penalty for any violation shall not excuse the violation or
<br />permit it to continue; and all such persons shall be required to correct or remedy such violations
<br />or defects within a reasonable period of time; and unless otherwise specified, each ten days that
<br />prohibited conditions are maintained shall constitute a separate offense.
<br />B. The application of the above penalty shall not be held to prevent the
<br />enforced removal of prohibited conditions."
<br />SECTION 5. The passage of this Urgency Ordinance is necessary in order to
<br />preserve the public peace, health and safety for the reasons set forth in the Recitals.
<br />SECTION 6. Severability. If any section, subsection, subdivision, paragraph,
<br />sentence, clause or phrase added by this Urgency Ordinance, or any part thereof, is for any
<br />reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction,
<br />such decision shall not affect the validity or effectiveness of the remaining portions of this
<br />Ordinance or any part thereof. The City Council hereby declares that it would have passed each
<br />section, subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of
<br />the fact that any one or more subsections, subdivisions, paragraphs, sentences, clauses or
<br />phrases are declared unconstitutional, invalid or ineffective.
<br />SECTION 7. Effective Date. This Urgency Ordinance shall take effect
<br />immediately upon its adoption.
