1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-10-05 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />COLTON AMENDING CHAPTERS 6.32 AND 15.16 OF THE <br />COLTON MUNICIPAL CODE REGARDING THE REGULATION <br />OF FIREWORKS <br />WHEREAS, previous Fourth of July holiday seasons have resulted in significant fire - <br />related property damage and personal injuries in the City; and <br />WHEREAS, the Colton Fire Department has determined that the majority of fire -related <br />property damage and personal injuries related to fireworks are a result of illegal fireworks rather <br />than safe and sane fireworks which are approved by the State Fire Marshal; and <br />WHEREAS, the Colton Fire Department has identified the need for the fireworks <br />regulations in the Colton Municipal Code to be amended to include clear and concise language <br />prohibiting the sale, use, discharge and/or possession of illegal fireworks; and <br />WHEREAS, the City Council desires to adopt the provisions of the Colton Municipal Code <br />as amended by this Ordinance, which are intended to reduce the risk of fire hazards and fire - <br />related injuries from the sale, discharge, use and possession of illegal fireworks; and <br />WHEREAS, it is necessary for the amendments to the Colton Municipal Code, as <br />provided herein, to take effect immediately so that the requirements, as set forth in the <br />amendments, may be enforced for the approaching Fourth of July holiday season; and <br />WHEREAS, immediate amendment of the provisions pertaining to the regulation of <br />fireworks as set forth in this Ordinance will be in the interest of the public health, safety and <br />general welfare and will help to diminish the risk of fire hazards and fire -related injuries in the <br />City of Colton, while still preserving the rights of organizations and individuals to engage in the <br />retail sale and use of safe and sane fireworks; and <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: <br />SECTION 1. Section 6.32.010 of Chapter 6.32 of the Colton Municipal Code is <br />hereby deleted in its entirety and restated to read as follows: <br />- 1 - <br />
