1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-16-05 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />COLTON AMENDING CHAPTERS 3.08, 13.04, 13.16, 15.36 AND <br />18.58 OF THE COLTON MUNICIPAL CODE RELATING TO <br />RESPONSIBILITIES OF THE CITY ENGINEER TO REVIEW AND <br />APPROVE PLANS <br />WHEREAS, the California Professional Engineer's Act (Business and Professions <br />Code §§ 6700-6799) ("the Act") defines the scope of civil engineering to include the studies or <br />activities in connections with fixed works for irrigation, drainage, waterpower, water supply, flood <br />control, inland waterways, harbors, municipal improvements, railroads, highways, tunnels, <br />airports and airways, purification of water, sewerage, refuse disposal, foundations, grading, <br />framed and homogeneous structures, buildings, or bridges, while also stating that civil <br />engineering also includes city and regional planning which relates to these fixed works; and <br />WHEREAS, numerous provisions in the Colton Municipal Code require the sole or <br />final approval by the City Engineer and do not allow the City Engineer to delegate his authority to <br />another individual or department; and <br />WHEREAS, Government Code section 37103 allows a public entity to contract <br />with any specially trained and experienced person, firm, or corporation for special services and <br />advice in financial, economic, accounting, engineering, legal, or administrative matters and may <br />pay such compensation to these experts as it deems proper; and <br />WHEREAS, consistent with the Act the City desires to allow the City Engineer the <br />option to delegate certain responsibilities to a licensed engineering firm or licensed contract <br />engineering firm pursuant to Government Code section 37103. <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: <br />SECTION 1. Section 3.08.050 (D) of the Colton Municipal Code is hereby <br />amended in its entirety to read as follows: <br />-1- <br />
