1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 0-22-05 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON APPROVING A ZONE CHANGE FROM R-2 (DUPLEX RESIDENTIAL) TO M-1 (LIGHT INDUSTRIAL) FOR PROPERTY LOCATED ON THE WEST SIDE OF FOGG STREET, SOUTH OF EAST M STREET AND NORTH OF CONGRESS STREET (FILE INDEX NO. DAP -000-501) WHEREAS, the Colton Police Department filed an application (File No. DAP - 000 -501) requesting a zone change to change the zoning designation from R-2 ("Duplex Residential") to M-1 ("Light Industrial") ("Application") for property located on the west side of Fogg Street, south of East M Street and north of Congress Street (Assessor Parcel No. 0163-232-024) in the City of Colton, County of San Bernardino ("Subject Site"); and WHEREAS, the City of Colton Planning Commission ("Planning Commission") held a public hearing on the Application on October 11, 2005, after giving published notice of the Application; and WHEREAS, the Planning Commission has determined that the proposed Application is consistent with the goals and policies of the City of Colton General Plan, is in the best interests of the City's general welfare and the public health and safety, and it would be in the public interest to recommend approval of the Application to the Colton City Council; and WHEREAS, the Application was reviewed, studied, and found to comply with the California Environmental Quality Act ("CEQA") as more fully described below; WHEREAS, the Planning Commission adopted a Resolution recommending approval of this Application to the City of Colton City Council; WHEREAS, on November 15, 2005, the City Council of the City of Colton ("City Council") conducted a duly noticed public hearing on the Application at which time all persons wishing to testify in connection with the Application were heard and the Application was fully studied; and ORANGENW 19705.1 -1-
