This moratorium further promotes the public's interest in the development <br />of an accurate general plan document and protects the economic revitalization efforts in <br />the City of Colton. <br />Section 2. Pursuant to Government Code Section 65858, the City <br />Council of the City of Colton hereby suspends the issuance or approval of any new <br />application, permit, entitlement or development approval for development of any land <br />or issuance of any approval authorizing the uses listed in Exhibit "A", effective upon the <br />adoption of this Urgency Ordinance, and continuing for the time set forth at Section 5 <br />below. Such suspension shall not apply to: (1) any application on file with the City of <br />Colton as of the effective date of this ordinance, provided all application fees have been <br />paid and all conditions necessary for the acceptance of an application as complete have <br />been met; (2) any applications made necessary by conditions or other requirements <br />placed by the final decision-making body of the City of Colton in its consideration of an <br />application meeting Exception 1 in this paragraph; and (3) any conditional use permit, <br />variance or site plan/design review permit or building permit approval previously <br />granted but not vested in accordance with California law. The uses that are subject to <br />this moratorium are more specifically defined in the attached Exhibit "B." <br />Section 3. Compliance with California Environmental Quality Act. The <br />City Council finds that this Urgency Ordinance is not subject to the California <br />Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will <br />not result in a direct or reasonably foreseeable indirect physical change in the <br />environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of <br />the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has <br />no potential for resulting in physical change to the environment, directly or indirectly; it <br />prevents changes in the environment pending the completion of the contemplated <br />general plan and zoning code revisions and related impact studies. <br />Section 4. Effective Date. This Urgency Ordinance was adopted by the <br />necessary four-fifths vote of the members of the City Council pursuant to California <br />Government Code Section 65858, and shall take effect immediately upon its adoption. <br />Section 5. Written Report. At least 10 days before this Urgency <br />Ordinance or any extension expires, the City Council shall issue a written report <br />describing the measures taken to alleviate the condition which led to the adoption of this <br />0RAN6F\MMAR I IN LZ23683.3 -3 - <br />
