The City Council further finds that the approval of additional <br />subdivisions, building permits, or other entitlements would result in a current and immediate <br />threat to the public safety, health, or welfare because consideration and approval of such uses <br />may be inconsistent with proposed land use designations and contemplated general and specific <br />plan policies now being studied. Such prohibitions on entitlements protect and promote the <br />planning process by, among other things, prohibiting the introduction of potentially <br />nonconforming land uses that could defeat the City's later -adopted General Plan, specific plan <br />and/or zoning ordinance. This moratorium further promotes the public's interest in the <br />development of an accurate general plan document and protects the economic revitalization <br />efforts in the City of Colton. <br />Section 5. Compliance with California Environmental Quality Act. The City <br />Council finds that —this Urgency Ordinance is not subject to the California Environmental Quality <br />Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably <br />foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a <br />project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, <br />Title 14, Chapter 3, because it has no potential for resulting in physical change to the <br />environment, directly or indirectly; it prevents changes in the environment pending the <br />completion of the contemplated general plan and zoning code revisions and related impact <br />studies. <br />Section 6. Effective Date. This Urgency Ordinance was adopted by the <br />necessary four-fifths vote of the members of the City Council pursuant to California Government <br />Code Section 65858, and shall take effect immediately upon its adoption. <br />Section 7. Written Report. At least 10 days before this Urgency Ordinance or <br />any extension expires, the City Council shall issue a written report describing the measures <br />taken to alleviate the condition which led to the adoption of this Urgency Ordinance. <br />Section 8: Publishing. The City Clerk shall certify to the passage of this <br />Urgency Ordin�_nceand cause the same or a summary thereof to be published within fifteen (15) <br />days after adoption in a newspaper of general circulation, printed and published in Colton, <br />California. <br />Section 9. Term. This Ordinance is an Urgency Ordinance, enacted pursuant <br />to GovernmenFC—ode section 65858. The term of this Urgency Ordinance shall be for ten (10) <br />months and fifteen (15) days from the date of adoption – May 2, 2006 - and shall expire and be <br />of no further force or effect, unless and until extended in accordance with Government Code, <br />Section 65858. <br />PASSED, APPROVED AND ADOPTED this 5th day of May, 2006. <br />ATTEST: <br />CAROLINA P.
