Remaining Provisions. The City Council hereby finds that all <br />remaining sections and provisions of Ordinance 0-02-00 shall remain in full force and effect. <br />SECTION 4. Severability. If any provision or clause of this Ordinance or any <br />application of it to any person, firm, organization, partnership or corporation is held invalid, such <br />invalidity shall not affect other provisions of this Ordinance which can be given effect without the <br />invalid provision or application. To this end, the provisions of this Ordinance are declared to be <br />severable. <br />SECTION 5. CEQA Findings. The City Council hereby finds and determines <br />that it can be seen with certainty that there is no possibility that this Ordinance may have a <br />significant adverse effect on the environment. Thus, the adoption of this Ordinance is exempt <br />from the requirements of the California Environmental Quality Act (Public Resources Code §§ <br />21000 et seq.) ("CEQA") pursuant to Section 15061(b)(3) of the CEQA Guidelines. This <br />Ordinance merely establishes authority for the collection of development impact fees. Staff is <br />directed to file a Notice of Exemption with the San Bernardino County Clerk's Office within five <br />(5) working days of the adoption of this Resolution. <br />SECTION 6. Effective Date. This Ordinance shall become effective thirty (30) <br />days after its adoption. However, the Traffic Impact Fees adopted herein shall not become <br />effective until sixty (60) days after the adoption of this ordinance. <br />PASSED, APPROVED AND ADOPTED this 19th day of September, 2006. <br />�eT7ST: <br />CAROLINA P.
