1 <br />2 <br />3 <br />4 <br />13 <br />14 <br />-15 <br />OR <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />2,5 <br />261 <br />27� <br />281 <br />29 <br />30 <br />31 <br />32 f <br />RESOLUTION NO. 3620 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />TO DETERMINE THE DISABILITY FOR RETIREMENT PURPOSES <br />OF A LOCAL SAFETY MEMBER (SECTION 21023.6, CALIFORNIA <br />GOVERNMENT -CODE) <br />WHEREAS, the City of Colton (hereinafter referred to as <br />Agency) is a contracting agency of the Public Employees' Retire= <br />Ment System and, <br />WHEREAS, the Public Employees' Retirement Law requires <br />thata contracting agency determine whether an employee of such <br />agency, in employment in which he is classified .as a local safety <br />member, is disabled for purposes of the Public Employees' <br />Retirement Law and whether such disability is "industrial" within <br />the meaning of such law; and, <br />WHEREAS, an application for disability retirement of <br />William O. Greer, employed by the Agency intheposition-of Fire <br />Captain, has been filed with the Public Employees Retirement <br />System and, <br />WHEREAS, the City Council has reviewed the medical and <br />other evidence relevant to such alleged disability; <br />NOW, THEREFORE, BE IT RESOLVED that the City Council <br />find and determine, and it does hereby find and determine, that <br />William 0. Greer is incapacitated within the meaning of the Public <br />Employees' Retirement Law for performance of his duties in the <br />position of Fire Captain; and <br />BE IT FURTHER RESOLVED that the City Council find and <br />determine, and it does hereby find and determine, that such <br />disability is not a result of injury or disease arising out of <br />and in the course of employment and neither said William. 0. Greer <br />
