RESOLUTION NO. 3656 RESOLUTION OF THE CITY COUNCIL OF THE.CITY OF COLTON l TO DETERMINE THE DISABILITY FOR RETIREMENT PURPOSES OF A LOCAL SAFETY MEMBER (SECTION 21023 6, CALIFORNIA 2 GOVERNMENT CODE) 3 d WHEREAS, the City of Colton (hereinafter referred to as 51 Agency) is a contracting agency of the Public Employees* Retire - 6 ment System; and, 7 WHEREAS, the Public Employees' Retirement Law requires 8 that a contracting agency determine whether an employee of such 9� 10� agency, in employment in which he is classified as a local safety 11 member, is disabled for purposes of the Public Employees' Retire 12 ment Law and whether such disability is "industrial" within the 13 meaning of such law; and, 14 WHEREAS, an application for disability retirement of 15 David Alex Pearson, Jr., employed by the Agency'in the position 161 of Police Community Relations Officer, has been filed with the 17 18 Public Employees' Retirement System; and, 19 WHEREAS, the City Council has reviewed the medical and 20 other evidence relevant to such alleged disability 211 NOW, THEREFORE, BE IT RESOLVED that the City Council find f 22 and determine, and it does hereby find and determine, that 23 David Alex Pearson, Jr., is incapacitated within the meaning of 24 the Public Employees' Retirement Law for performance of his 25,, 26 duties in the position of Police Community Relations offices; and 27 BE IT FURTHER RESOLVED that the City Council find and de 28 termine, and it does hereby find and determine, that such dis- 29 ability is the result of injury or disease arising out of and 30 in the course of employment p yment and neither said David Alex Pearson, 31 Jr. nor the Agency of the City of Colton has applied to the 32 Workmants Compensation Appeals Board for a determination pursuant
