RESOLUTION NO. 3675 1 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON TO DETERMINE THE DISABILITY FOR RETIREMENT PURPOSES OF A LOCAL SAFETY MEMBER (SECTION 21023.6, CALIFORNIA 3 GOVERNMENT CODE) 4 WHEREAS, the City of Colton (hereinafter referred to as Agency) 5 is a contracting agency of the Public Employees' Retirement System;, and, 6 WHEREAS, the Public Employees' Retirement Law requires that 7 a contracting agency determine whether an employee of such agency, in employment 8 in which he is classified as a local safety member, is disabled for purposes of 9 the Public Employees' Retirement Law and whether such disability is "industrial" 10 within the meaning of such law; and,, 11 WHEREAS, an application for disability retirement of FRANK V. 12 ; STRATTON, employed by the Agency in the position of Police Detective, has been 13 filed with the Public Employees' Retirement System; and, 14 WHEREAS, the City Council has reviewed the medical and other 15 evidence relevant to such alleged disability; 15 NOW, THEREFORE, BE IT RESOLVED that the 'City Council find.and 17 I determine, and it does hereby find and determine, that FRANK V. STRATTON, is 18 1 incapacitated within the meaning of the Public Employees' Retirement Law f or 19 performance of his ,duties in the position of Police Detective; and, 20 BE IT FURTHER RESOLVED that the City Council find and determine 21 and it does hereby find and determine, that such disability is the result.of 22- I injury or disease arising out of and in the course of employment and neither 23 said FRANK V. STRATTON, nor the Agency of the City of Colton has applied to the 24 Workman's Compensation Appeals Board for a determination pursuant to Section 25 21023.6 whether such di sabi 1 i ty is industrial. 26 PASSED, APPROVED and ADOPTED this 1st day of March, 1977. 2'7 1 2 l ATTEST: f,1AYOR
