RESOLUTION NO. 3676 CITY OF COLTON RESOLUTION OF THE CITY,COUNCIL ORDERING WORK TO BE EXECUTED AND PERFORMED BY CITY FORCES IN A SPECIAL ASSESSMENT DISTRI,CT. ASSESSMENT DISTRICT NO. 1976-1 (COOLEY DRIVE) WHEREAS., this City Council has.formed a special assess- ment district pursuant to the terms and provisions of the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California, for the construction of certain public works -of improvements; said special assessment district is known and designated as ASSESSMENT DISTRICT NO. 1976=1 (COOLEY . DRIVE ) (hereinafter referred to as the "Assessment District"); and, WHEREAS, pursuant to Section 10506 of the Streets and Highways Code of -the State of California, any time after the preliminary approval of the.Report,_this City Council may, by a Resolution adopted by`a vote of two-thirds (2/3) of its members order that the City, itself, execute all or any portion of the improvement in -accordance with the plans and specifications and it is hereby determined, at this time, to be more economical and within the best public interest and general welfare -to do SO. i . NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLTON AS FOLLOWS: SECTION 1. That the above recitals are all true and -correct. SECTION 2.- That pursuant to Section 105.06 of the Streets and Highways Code of the State of California, this City shall perform certain works of improvements in the assessment district and authorization is also given, if necessary, to employ the labor and provide the materials, appliances,: and supplies, all necessary to carry out the following portions of the work: [SEE EXHIBIT "A" ATTACHED HERETO REFERENCED AND MADE A PART HEREOF] SECTION 3. That it is hereby further determined that said works of improvement above mentioned is necessary for the Assessment District and is determined to be in the best interests of the property owners to be performed by.the municipality and that the costs and expenses for said works of improvements shall be paid out of the Improvement Fund, but the amount appropriated shall not exceed the amount as set forth in the Engineer's Report for the works of improvement.
