1' <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />9 <br />10 <br />11: <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />of 2, 3 or 4 years, with the differentiation between first and second degree <br />robbery removed; murder in the second degree which now carries an indetermi- <br />nate sentence of 5 years to life, will have a fixed term of 5, 6 and 7 years; <br />and assault with intent to commit murder, which now carries with it an in- <br />determinate sentence of l to 14 years, will carry ,with it a sentence of 2, 3 <br />and 4 years; and <br />WHEREAS, these are but examples of certain crime categories, <br />but all crimes generally fit within these three ranges. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council .of the <br />City of Colton does hereby indicate its opposition to SB 42 as enacted into <br />law effective July 1, 1977, and does hereby express its recommendation to the <br />California State Legislative Board that emergency amendments be immediately <br />instituted to lengthen the determinate sentences for violent crimes, particu- <br />larly murder in the second degree, rape, mayhem, kidnapping, robbery and <br />assault with intent to commit murder; and eliminate the so-called "good time" <br />credit so that judges, in setting these sentences, can be certain of the <br />actual time an individualwill serve in prison and so that the sentences for <br />these crimes can be lengthened, where necessary, and individuals who continue <br />to be a threat to society will remain incarcerated; and <br />BE IT FURTHER RESOLVED, that the City Council of the City of. <br />Colton does recommend to the Legislature that the provisions for parole for <br />non -lifers be extended from one year to at least three years, and the parole <br />for lifers be extended from three years to five years, with the provision that <br />a parole infraction resulting in the suspension of parole time, be changed <br />from "good time" to "dead time,"; and <br />BE IT FURTHER RESOLVED that the City Council of the City of <br />Colton also urges an emergency amendment to redefine the sections on "enhance- <br />ments" in a clear and definitive manner, which would provide for maximum terms <br />
