I 2� 3 4 5 6 7 8 9 10I I 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 3689 i RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON TO DETERMINE THE DISABILITY`FOR RETIREMENTS°PURPOSES OF A LOCAL SAFETY MEMBER (SECTION 21023.6, CALIFORNIA GOVERNMENT CODE) WHEREAS, the City of Colton (hereinafter referred to as Agency) is a contracting agency of the Public Employees' Retirement System; and, WHEREAS, the Public Employees' Retirement Law requires that a contracting agency determine whether an employee of such agency, in employmentinwhich he is classified as a local safety member, is disabled for purposes of the Public Employees' Retirement Law and whether such dis- ability is "industrial" within the meaning of such law; and, WHEREAS, an application for disability retirement of Bernard Henry Hern, employed by the Agency in the position of Police Sergeant has been filed with the Public Employees' Retirement System; and, WHEREAS, the City Council has reviewed the medical and I other evidence relevant to such alleged disability; NOW, THEREFORE, BE IT RESOLVED that the City Council find and determine, and it does hereby find and determine that Bernard Henry Hern, is incapaci-tated within the meaning of the Public Employees' Retire- ment Law for, performance of his duties in the position of Police Sergeant; and BE IT FURTHER RESOLVED that the City Council find and determine, and it does hereby find and determine, that such disability is the result of injury or disease arising out of and in the course of employment and neither said Bernard Henry Hern nor the Agency of the City of Colton has applied to the Workman's Compensation Appeals.Board for a determination pur- suant to Section 21023.6 whether such disability is industrial.
