3 P2 V r.� 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19. 2Q 21 22 23' 24 11 25 11 26 27 28 29 RESOLUTION NO. 3690 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON TO DETERMINE THE DISABILITY FOR RETIREMENTPURPOSES OF A LOCAL SAFETY MEMBER (SECTION 21023.6, CALIFORNIA GOVERNMENT CODE) WHEREAS, the City of. Colton (hereinafter referred to as Agency) is a contracting agency of the Public Employees' Retirement System; and, WHEREAS, the Public Employees' Retirement Law requires that a contracting agency determine whether an employee of such agency, in employment in which he is classified as a local safety member, is disabled for purposes of the Public Employees' Retirement Law andwhethersuch dis- ability is "industrial" within the meaning of such law; and,. WHEREAS, an application for disability retirement of William 0. Greer, employed by the Agency in the position of Fire Captain, has been filed with the Public Employees' Retirement System; and, WHEREAS, the City Council has reviewed the medical and other evidence relevant to such alleged disability; NOW, THEREFORE, BE IT RESOLVED that the City Council find and determine, and it does hereby find and determine, that William 0. Greer, is incapacitated within the meaning of the Public Employees' Retire- i ment Law for performance of his duties in the position of Fire Captain; and BE IT FURTHER RESOLVED that the City Council find and determine, and it does hereby find and determine, that such disability is the result of injury or disease arising out of and in the course of employment in accordance with a determination of the Workers Compensation Appeals Board under an April 20,-1977 finding of fact pursuant to Section 21026 of the Government Code.
