Colton (hereinafter referred to <br />as Agency) is a contracting agency of the Public Employees' Retirement System; <br />and, <br />WHEREAS, the Public Employees' Retirement Law requires <br />that a contracting agency determine whether an employee of such agency, <br />in employment in which he is classified as a local safety member, is disabled <br />for purposes of the Public Employees' Retirement Law andwhethersuch dis- <br />ability is "industrial" within the meaning of such law; and,. <br />WHEREAS, an application for disability retirement of <br />William 0. Greer, employed by the Agency in the position of Fire Captain, <br />has been filed with the Public Employees' Retirement System; and, <br />WHEREAS, the City Council has reviewed the medical and <br />other evidence relevant to such alleged disability; <br />NOW, THEREFORE, BE IT RESOLVED that the City Council <br />find and determine, and it does hereby find and determine, that William 0. <br />Greer, is incapacitated within the meaning of the Public Employees' Retire- <br />i <br />ment Law for performance of his duties in the position of Fire Captain; and <br />BE IT FURTHER RESOLVED that the City Council find and <br />determine, and it does hereby find and determine, that such disability is <br />the result of injury or disease arising out of and in the course of employment <br />in accordance with a determination of the Workers Compensation Appeals <br />Board under an April 20,-1977 finding of fact pursuant to Section 21026 of <br />the Government Code. <br />BE IT FURTHER RESOLVED that -this resolution supercedes <br />Resolution No. 3620. <br />7977, PASSED, APPROVED and ADOPTED` this 24th day of May, <br />30 <br />31 ` ATTEST: <br />32 <br />HELEN A.
