LAFC 1775 - Resolution No. 1376 - Page Two DETERMINATIONS: t SECTION'l. The proposal is approved subject to the terms and conditions hereinafter specified. CONDITIONS: Condition No. T The conducting authority shall not make any changes in the boundaries hereby approved nor shall it impose any new conditions or modify any conditions hereby imposed unless and until it receives the approval of the Local Agency Formation Commission for such changes, modifications, or conditions, pursuant to the procedures prescribed in Section 35152 of the Government Code. condition No. 2. The conducting authority shall provide the Local Agency Formation Commission Executive Officer with a copy of the certified resolution indicating final disposition of the proposal pursuant to Government Code Section 35201. Condition No. 3. The following distinctive short form designation shall be used throughout this proceeding: LAFC 7775 Condition No. 4. The conducting authority for this proceeding shall be the City Of Colton; Condition No. S. Approval is granted to the conducting authority to proceed without notice; hearing, or election, as provided 5y law in Government Code Section 35221, with 100% consent of the property owners. Condition No. 6.Immediately upon annexation, the area should be detached from CSA 38, and CSA 38 Improvement Zone G; CSA 70, and CSA 70, Improvement Zone A, without Split of assets or liabilities. SECTION 2. The governing body of the conducting authority is hereby directed to initiate appropriate proceedings in compliance with this resolution and state law. If Proceedings are not initiated within 35 days of this LAFC Resolution the proceedings may be subject to the provisions of Government Code Section 35202. ` SECTION 3. The Executive Officer is hereby authorized and directed to mail certified Copies of this resolution in the manner as provided in Section Section 35201 of the Government Code, and applicable sections of CEQA. SECTION 4. Approval by the Local Agency Formation Commission indicates that approval of this proposal by the conducting authority would accomplish the proposed change of organization in a reasonable manner with a maximum chance of success and a minimum disruption of service to the functions of other local agencies in the area.
