RESOLUTION NO. 3795 <br />RESOLUTION OF THE CITY COUNCIL MAKING; <br />FINDINrS ON PETITION. <br />CITY OF COLTON <br />WHEREAS, certain property owners have presented an executed _ <br />Petition requesting the construction of certain public works <br />of improvement,.together with appurtenances and appurtenant <br />work in connection therewith; said improvements to be con- <br />structed pursuant to the terms and provisions of the "municipal <br />Improvement Act of 1913", being Division 12 of the Streets and <br />Highways Code of the State of California, with bonds to be <br />issued to fund and finance said improvements pursuant to the <br />bond terms of the "Improvement Act of 1911", being Division 7 <br />of said Code, in a special assessment district known and desig- <br />nated as <br />ASSESS14ENT DISTRICT NO. 78-1 <br />[MT. VERNON AVENUE AND COOLEY DRIVE, PHASE 111 <br />(hereinafter referred to as the "Assessment District"); and, <br />%THEREAS, it has been reported that said Petition contains the <br />signatures of at least five (5) owners owning more than sixty <br />percent (60%) of the property of the assessable area of the <br />property -to be subject to assessment for the proposed works of. <br />improvement. Said Petition meets the reauirements of Section. <br />2804 of Division 4 of the Streets and Highways Code of the <br />State of California; and,_ <br />WHEREAS, said Petition further meets the requirements of Chapter <br />8 of the "Improvement Act of 1911", and specifically Sections <br />5896.5 and 5896.6 of said Code. <br />NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF COLTON <br />CALIFORNIA, AS FOLLOWS <br />SECTION 1. That the above recitals are all true and correct. <br />SECTION 2. That said City Council finds that said Petition' <br />has been signed by five (5) owners of assessable <br />land, as well as owners owning land constituting <br />more than sixty percent (60%) of all assessable <br />lands within the boundaries of the proposed <br />Assessment District. <br />SECTION 3. That said Petition shall he filed in the Office <br />of the City Clerk and shall remain open to.public <br />inspection. <br />SECTION 4. That said Petition meets the requirements of sec- <br />tion 2804 of Division 4 of the Streets and High- <br />ways Code of the State of California and further <br />
